1. Operator and contact

This website is operated by Jason Tabinas, trading as The Sculpt Strap.

2. Scope

These Terms & Conditions apply to every order placed through thesculptstrap.com or any other sales channel operated by The Sculpt Strap. By placing an order you confirm that you are at least 18 years old and legally capable of entering into a contract.

3. Products and pricing

We sell the V-Line facial slimming mask marketed as "The Sculpt Strap" and related accessories. Product descriptions, images and bundle offers are for information only and do not constitute a binding offer.

Prices are displayed in the currency selected by the site and include any applicable taxes at the point of sale. We do not charge VAT because the operator is not currently VAT-registered in Switzerland. Import duties, customs fees or local taxes charged on delivery are the buyer's responsibility unless the product page explicitly states otherwise.

We reserve the right to correct pricing errors before a contract is formed. If a product becomes unavailable after you place an order, we will notify you and refund any payment received.

4. Ordering and contract formation

Placing an order through our checkout is a binding offer to buy. The contract is formed when we send an order confirmation email or begin processing your payment, whichever comes first. We may refuse an order for reasons such as suspected fraud, stock unavailability or shipping restrictions.

5. Payment

Payments are processed securely by Shopify Payments. Depending on your location you may pay by major credit or debit card, Shop Pay, PayPal and other methods Shopify makes available. Your payment method is charged when the order is placed. All payment data is handled by Shopify and the relevant payment provider; we do not store full card details.

6. Shipping and delivery

We ship internationally. Delivery usually takes 4–12 business days from the shipping confirmation, depending on the destination and carrier. Shipping is free on all orders unless a specific promotion states otherwise.

Risk of loss or damage passes to you when the order is handed to the carrier. We are not liable for delays caused by customs clearance, carrier disruptions, incorrect delivery addresses or other events outside our reasonable control.

7. Right of withdrawal and returns

If you are a consumer, you have the right to cancel your order within 14 days of receiving the goods without giving a reason. To exercise this right, contact us by email at support@sculptstrap.com with your order number.

Items must be returned unused, undamaged and in their original packaging. We will provide a return label and cover the return shipping cost. Once we receive and inspect the returned item, we will refund the purchase price within 14 days using the same payment method you used for the original purchase.

The right of withdrawal does not apply to sealed goods that have been unsealed after delivery for health or hygiene reasons, unless the goods are defective.

8. Warranty

For customers in Switzerland, the statutory warranty period is two years from delivery. Customers in other countries receive the warranty protection provided by the applicable consumer law in their jurisdiction. Please report any defect as soon as you notice it and include photos and your order number.

Warranty claims do not cover normal wear and tear, damage caused by improper use, or cosmetic differences that do not affect function.

9. Liability

We are liable for direct damages caused by our intentional or grossly negligent conduct. Liability for slight negligence is excluded to the extent permitted by law, except for breaches of essential contractual duties. We are not liable for indirect, consequential or lost-profit damages.

Mandatory statutory liability, in particular under product liability and personal injury law, remains unaffected.

10. Data protection

We process personal data only to the extent necessary to operate this shop, fulfill your order and communicate with you. Order data is processed by Shopify and the payment provider you choose. We do not sell personal data.

11. Intellectual property

All content on this website, including text, images, logos, videos and product designs, is owned by The Sculpt Strap or its licensors. You may not copy, reproduce, distribute or modify any content without our prior written consent.

12. Governing law and jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-laws rules. For disputes arising from contracts with consumers, the mandatory jurisdiction at the consumer's place of residence or domicile remains reserved where applicable. Otherwise, the exclusive place of jurisdiction is Bern, Switzerland.

13. Changes to these terms

We may update these Terms from time to time. The version in force at the time you place your order applies. Continued use of the website after changes are posted constitutes acceptance of the updated terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
